In conformance with the judgment of the Supreme Court of Alabama dated December 9, 1977, 353 So.2d 1165, the judgment of the Circuit Court of Jefferson County, Alabama, of August 2, 1976, is reversed and this case is remanded to that court for further proceedings therein.

REVERSED AND REMANDED.
