Pursuant to the Alabama Supreme Court’s decision in Ex parte Garrett,

608 So.2d 337 (Ala. 1992), the judgment of the circuit court is reversed and the case remanded to the circuit court for proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.

All the Judges concur.
